This paper defines test-based fire risk assessment as it is used for economic and legal analysis. Its economic use is illustrated by cost-benefit and risk-benefit techniques. Its legal use is discussed in the context of tort liability, contracts, and regulation. In both areas, there is a need for definition of the risks being measured, the confidence in the result, and the type of assessment and data being produced.
